MCRCB/MSVR Judicial Bulletin - Oooops - Caught !!

Routine eligibility checking procedures and enquiries carried out in respect of the GBmoto Racing Team machines of #33 Tristan Palmer and #20 David Johnson revealed that the machines (a) had cam timing bolts undercut to alter the standard timing, and (b) had non-standard cylinder base gaskets, contrary to the MCRCB Superstock Technical Regulations 5.2.7 and 5.2.7.11.

Accordingly and in accordance with the MCRCB Judicial Procedures B.4.5.1.2 the Judicial Clerk of the Course excluded #33 Tristan Palmer and #20 David Johnson from the results of the Oulton Park Superstock 1000 race, and in view of the team's voluntary admission that the machines had been prepared in a similar manner at earlier rounds of the championship, the Judicial Clerk of the Course referred the matter to the MCRCB Judicial Panel for consideration of further penalties. There was no appeal against these decisions.

The Judicial Panel, comprising Mervyn Whyte (Chairman) and Adrian Johnstone, the MCRCB Stewards, and Dave Francis, the MSVR Judicial Clerk of the Course, met at Brands Hatch on 5 August 2011 to further consider this matter. They met with Mark Smith-Halvorsen, the GBmoto Racing Team Principal.

The Panel decided to impose additional penalties on #33 Tristan Palmer and #20 David Johnson in accordance with the MCRCB Judicial Procedures B.4.5.2.3

"forfeit a total of points no greater than those obtained from two first places even if this penalty results in a minus total of points"

Accordingly both riders were penalised 50 championship points by the Panel.

There have been no appeals against these penalties, and therefore the decision is confirmed.
